Dubai Courts Eases Debt Recovery

An execution judge can authorize the sale through a public auction of mortgaged or pledged property that is under legal dispute, without obtaining a final judgment, according to legal circles in Dubai, quoted by Gulf News.  

The Emirati daily cited a circular issued by the Chief Justice of the Dubai Courts stating that "any action for the sale of mortgaged or pledged property due to non-payment shall be filed under a case and application independent from the main civil action.  

"These cases shall be heard by the execution judge, who may issue a judgment regarding the sale of the mortgaged property even before the main action is filed,” the paper quoted a legal expert as saying – Albawaba.com
