The Israeli-headquartered Syneron Inc. has filed a seven-million dollar cross-complaint against another Israeli medical laser company, Lumenis Ltd., alleging trade disparagement, intentional interference with prospective economic advantage and unfair competition.
The first lawsuit was filed by the Nasdaq-traded Lumenis in Tel Aviv District Court in Israel on September 12, 2002, against Syneron Medical Devices, Ltd. and certain individual defendants, who are former employees of ESC Medical Systems Ltd., the predecessor to Lumenis, for misappropriation of trade secrets, conversion of confidential business information and breach of fiduciary duty. The lawsuit seeks $6.3 million in damages as well as injunctive relief.
Another lawsuit was filed by Lumenis in October 28 in a US District Court. Lumenis sued Syneron for willful infringement of several of the Lumenis' US patents in the manufacture and sale of Syneron products. The suit sought unspecified damages as well as a preliminary and permanent injunction against the continued infringement of these patents.
Along with this lawsuit, Lumenis also filed a motion for a temporary restraining order for immediate consideration by the court. In November, a US federal judge dismissed Lumenis’ motion for a temporary restraining order against Syneron Inc.
