The Supreme Administrative Court accepted the appeal by the Egyptian government, to continue to allow the exports of Egyptian natural gas to Israel. However, it ordered to take into account domestic consumption and international prices.
The Egyptian government appealed a previous decision issued by the Administrative Court of first instance, which banned the export to Israel at prices lower than international prices and market value. However, the Supreme Administrative Court reversed that decision and ruled that the court did not have the authority to discuss the case, on the grounds that the export of gas is "a sovereign decision which can not be interfered by courts."
The Supreme Administrative Court in its Saturday's ruling urged the government to develop a mechanism to export gas, taking into account international prices and domestic consumption of gas. Note that this provision is final and irreversible and not subject to appeal.
The sale of Egyptian gas to Israel sparked a wave of popular anger, considered as a kind of normalization with Israel on the one hand, and because the agreement was to sell gas at lower prices, which damage the Egyptian economy on the other hand.
